Terms of Service

You must be at least 13 years old to create an account. If you are under 18, you may only use the App with the consent of a parent or guardian. Parents can create child profiles under their own account using the App's Kids Mode feature.

You are responsible for keeping your account secure and for all activity that occurs under your account. You agree not to impersonate others or provide intentionally misleading account information. We reserve the right to suspend or terminate accounts that violate these Terms.

Your account is for your personal use only. You may not share your login credentials or allow others to access your account. You may use the App on multiple devices. Parents may create and manage child profiles under their account using Kids Mode.

You can delete your account at any time from within the App. When you do, your data will be deleted from our servers.

By creating an account, you agree to receive essential communications related to your account, such as security alerts and policy updates. We may also send emails about new content, features, or other updates related to the App. You can unsubscribe from non-essential emails at any time.

Push notifications are primarily used for practice reminders but may also be used for other communications in the future. You can disable push notifications at any time in the App's settings or in your device's notification settings.

You agree not to use the App to:

• Upload or display offensive, abusive, or inappropriate content in your profile, including your username, name, bio, or avatar
• Harass, impersonate, or harm other users
• Attempt to manipulate leaderboards or exploit the App in unintended ways
• Reverse-engineer, decompile, or tamper with the App
• Use the App for any unlawful purpose

We use automated safeguards to help prevent inappropriate profile photos, usernames, bios, and names from appearing on the platform. However, no system is perfect and we cannot guarantee that all inappropriate content will be caught. If you encounter something that seems inappropriate, please report it to us.

All books, music, audio, and other learning materials available in the App are the property of Fluency LLC and are protected by copyright and intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access this content within the App for personal, non-commercial language learning purposes only.

You may not copy, download, record, reproduce, distribute, republish, or create derivative works from any Fluency-owned content outside the App. You may not scrape, crawl, or use automated tools to extract content from the App. Any unauthorized use of our content is a violation of these Terms and may result in immediate account termination. Fluency LLC reserves the right to pursue any and all legal remedies available for intellectual property infringement. If you become aware of any unauthorized use of Fluency content, please notify us at storyfluent@gmail.com.

Videos in the App are sourced from YouTube and are displayed via YouTube's embedded player. These videos and their subtitles are owned by their respective creators and are subject to YouTube's Terms of Service. Video content may contain explicit language, sexual themes, references to alcohol or drugs, violence, or other material that some users may find controversial or offensive. Fluency does not control, endorse, or assume responsibility for any third-party video content. You access such content at your own discretion.

The App may include open-source software components, which are subject to their own respective licenses.

Content in the App — including books, songs, and videos — may be added, updated, or removed at any time. We are always working to expand our library, but we cannot guarantee that any specific piece of content will remain available indefinitely.

While we strive for accuracy, content in the App may contain errors, inaccuracies, or imperfections in translations, text, or audio.

Your saved data — such as flashcards, reading history, favorites, and activity — is your personal data. We store and sync it to provide the App's features, as described in our Privacy Policy.

We reserve the right to take action on accounts that violate these Terms. This may include forcing a profile into private mode, temporarily suspending an account, or permanently banning a user. We will make reasonable efforts to notify affected users but are not obligated to do so in all cases.

We also reserve the right to remove or modify any user-generated content — including profile information such as usernames, names, bios, and avatars — that we determine to be inappropriate, offensive, promotional, misleading, or otherwise in violation of these Terms, without prior notice.

The App may offer optional ongoing subscriptions and one-time purchases. Some content, features, or usage levels may require a paid plan to access. Available content, features, usage levels, and pricing may vary by user and region. All purchases made through the App Store or Google Play are subject to the respective platform's refund policies.

Lifetime access. The App may offer a one-time payment for lifetime access. "Lifetime" means the lifetime of the App — we intend to operate the App for the long term and have no plans to shut it down. In the unlikely event the App is discontinued, your lifetime access ends with the service. If the App is discontinued within a reasonable time of your purchase, you may be eligible for a full or partial refund through the App Store or Google Play under their respective refund policies. However, Fluency LLC does not independently guarantee refunds, particularly for purchases made long before a discontinuation. Lifetime plans may be subject to usage limits on certain features — see Section 7 (Usage Limits & Add-Ons) for details.

Ad-supported plans. Some users or regions may be offered an ad-supported plan as an alternative to paid subscriptions. Ad-supported plans may not include access to all content or features — upgrading to a paid plan may be required to unlock certain content. Ad-supported offerings may be added, modified, or removed at our discretion.

Promotions. We may offer promotional access, free trials, or other offers at our discretion. A promotional offer does not mean the App or any feature will remain free indefinitely. Promotions do not create an ongoing entitlement and may be modified or ended at any time.

Certain features involve significant ongoing costs to operate, such as live translations, AI-powered learning assistants, and other services that rely on external infrastructure. These features may be subject to usage limits depending on your plan.

Any usage limits will be clearly communicated at the time of purchase. If you reach a limit, optional add-ons may be available to increase your usage without requiring a plan change.

New features added after your purchase may also be subject to usage limits, even if they were not available or anticipated at the time of purchase. We reserve the right to adjust usage limits over time as costs and infrastructure evolve.

The App relies on third-party services for certain features, including video content and subtitles, translation services, and AI-powered learning tools. These services may change, degrade, or become unavailable due to factors outside our control — such as changes in third-party pricing, API availability, or content licensing.

We do our best to keep all features running smoothly. However, we cannot guarantee that any specific feature will be available indefinitely. Features may be added, modified, or removed over time. We will make reasonable efforts to communicate significant changes to our users.

The removal or modification of individual features does not entitle users to a full or partial refund for lifetime plans or active subscriptions. The App is offered as a whole product, not as a guarantee of any individual feature.

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components. Fluency is a language learning tool and does not guarantee any specific learning outcomes.

While we take reasonable steps to protect your data, loss of user data — including learning progress, flashcards, favorites, and reading history — can occur due to software bugs, device issues, server failures, third-party service disruptions, or other unforeseen circumstances. We are not liable for any lost or corrupted user data.

To the fullest extent permitted by law, Fluency LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill arising from your use of the App. Our total liability for any claim related to the App shall not exceed the amount you have paid us in the 12 months prior to the claim, or $50, whichever is greater.

You agree to indemnify and hold harmless Fluency LLC, its officers, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the App, or any content you submit through the App (such as profile information).

If you have a dispute with us, we encourage you to contact us first at storyfluent@gmail.com so we can try to resolve it informally.

If we can't resolve a dispute informally, you and Fluency LLC agree to resolve it through binding individual arbitration, rather than in court. Arbitration will be conducted under the rules of the American Arbitration Association (AAA). You agree to waive your right to participate in a class action lawsuit or class-wide arbitration. Either party may bring a claim in small claims court as an alternative to arbitration, provided the claim falls within that court's jurisdictional limits.

This agreement and any disputes arising from it are governed by the laws of the State of Wyoming, without regard to conflict of law provisions.

We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top of this page. For significant changes, we'll notify you through an in-app notice. Your continued use of the App after changes are posted means you accept the updated Terms.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fluency LLC regarding your use of the App and supersede any prior agreements or understandings.

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms are provided in English. If translated versions are made available, the English version controls in the event of any conflict.
